The price gap between two pool quotes is usually a gap in scope hidden in the contract. We explain the 10 clauses to check before you sign it.
The pool construction contract is the only document that binds what the price in the quote actually covers; a quote is an intention, while the contract is the answer to every dispute on site.
The most common regret among people who have a pool built is not the price but a scope surprise: excavation haulage billed separately, a plant room that was never part of the quote, no one to talk to when a warranty claim comes up.
None of this is bad luck. Each one is the cost of a question that was not asked before signing. The 10 clauses below are the contractual counterparts of the issues that cause the most disputes on site. Whichever company you work with, look for a written answer to each of these headings; used together with the list of questions to ask when choosing a pool builder, they make it possible to put quotes genuinely side by side.
The scope of work should not be written as a phrase open to interpretation such as 'turnkey pool', but listed item by item, from excavation to commissioning.
This is the first clause, and every other clause rests on it.
Items that should be listed one by one in the scope clause
- Who will prepare the soil survey and the structural and hydraulic designs
- Excavation, removal of the spoil from site and the disposal location
- Reinforced concrete shell: concrete class, reinforcement, waterproofing admixture
- Waterproofing and finish: material type, colour and range
- Mechanical installation: pipe diameters, built-in fittings, plant room
- Electrics: distribution board, residual current protection, lighting
- Commissioning: first fill, water balance, user training
At one company 'turnkey' includes landscape repairs and the power line; at another it does not. In our article on the limits of turnkey scope we explain separately which items this difference shows up in. If the contract uses this phrase, it must always be accompanied by an itemised list.
Yes, the brand and model of the pump, filter, disinfection unit, heater and lighting should be written into the contract; a contract that says 'quality pump' leaves the door open to the cheapest pump.
This is the second clause.
Two pumps of the same power can differ considerably in energy consumption, noise level and availability of spare parts. Once the model number is written down, at handover it is enough to walk into the plant room and read the label. If a product cannot be sourced, the word 'equivalent' may be used, but how equivalence will be proven and who will approve it are written into the same clause.
The exclusions list shows who is responsible for work that does not appear in the quote but is essential for the pool to operate, and this is exactly where an honest quote stands out.
This is the third clause.
Haulage of excavated material, bringing power and water to the site, the paving around the pool, landscape repairs, permit fees and the use of a breaker on rocky ground are the items most often excluded. Leaving them out of scope is not a fault; leaving them unwritten is. A contract without an exclusions list later turns into a list of disputes.
Payments should be tied to completed work: measurable stages such as excavation finished, shell cast or watertightness test passed become the condition for each payment.
The fourth clause is the work schedule, and the fifth is the payment plan linked to that schedule.
| Stage | Evidence that releases the payment |
|---|---|
| Contract and material order | Signed contract, approved design |
| Excavation and blinding concrete | Level survey, ground inspection report |
| Reinforced concrete shell | Pour record, completion of the curing period |
| Plumbing and waterproofing | Pressure test and watertightness test report |
| Finish and commissioning | Circulation, lighting and automation in working order |
| Final acceptance | Acceptance report and handover documents |
Each project sets the percentages in this table according to its own scale; what matters is that every row is tied to evidence. You can find the on-site counterpart of a stage-based payment structure in our article on the stages of pool construction. Tying the final payment to the acceptance report protects both sides.
The delay clause should separate delays caused by the company from technical necessities such as weather and concrete curing, and from obstacles caused by the owner.
This is the sixth clause. A daily penalty is defined for delays caused by the company, and a mutual time extension for obstacles on the owner's side (handover of the site, late approval of colour and model). Excavation is not carried out on rainy days, and concrete is not poured in freezing cold; adding these days to the schedule is a legitimate request, and if it is written into the clause, no dispute arises.
The warranty should not be written as a single word; separate periods and scope should be stated for the structural shell, the waterproofing and the equipment.
This is the seventh clause, because the single word 'warranty' says nothing.
The equipment warranty rests on the manufacturer's documents; handing the warranty documents and serial numbers over to you at completion is part of the clause. The waterproofing warranty is tied to the watertightness test. The contractor's liability for structural defects is also governed separately by law; the warranty clause in the contract does not replace this legal liability, it is added on top of it. The circumstances in which the warranty lapses (loss of chemical balance, unauthorised intervention, failure to winterise) should also be stated clearly. We give a 2-year warranty on our workmanship.
Occupational safety, the workers' insurance and any damage that may be caused to third parties are the contractor's responsibility, and this responsibility should be written clearly into the contract.
This is the eighth clause. Damage to a neighbour's wall, a utility line cut during excavation or an accident on site falls back on the owner if the contract leaves it unassigned. An uninsured crew working in your garden is a legal risk for you as well. If subcontractors are to be used, the same clause also states that the main company is responsible for the work as a whole.
Acceptance should be carried out not with a single signature but with a checklist written item by item; accepting with defects means approving an incomplete handover.
This is the ninth clause.
Checks to be ticked off one by one at acceptance
- Watertightness test report and level readings
- Circulation working from every return inlet and every skimmer
- Lighting, automation and the disinfection unit functioning
- Water balance established (pH, free chlorine)
- Handover of the structural and hydraulic designs, the plumbing layout drawing and the user manual
- Equipment warranty documents and serial numbers
The service clause defines the response time for fault reports, the periodic maintenance options and the supply of spare parts.
This is the tenth clause. A pool is a relationship that begins at handover, not one that ends there; in the first season, filter adjustment, the settling of the chemical balance and fine-tuning of the automation are always needed. Under a contract with no service clause, every call after handover becomes a new negotiation.
Before signing, put the quote, the brand and model list, the work schedule and the permit status side by side; if all four match, the contract is ready.
If they do not, stop, however attractive the price, because negotiating on site always costs more than negotiating at the table.
The permit question is often left until last, yet it should be settled before the contract is signed. In our article on the sequence of the permit application we explain which document is needed at which stage. If the project is large, or if you are undecided between several quotes, our pool consultancy service compares the quotes against these 10 clauses and gives you a written assessment. On our own projects we offer these clauses as part of our standard contract, and after the site survey we share a sample contract together with the quote.

The down payment should be kept at the level needed to start work and order materials, and the remaining payments should be tied to stage payments. Be cautious with quotes that ask for most of the price before work begins.

The warranty period usually starts on the day the acceptance report is signed, and this starting point should be stated clearly in the contract. The acceptance date and the tests carried out at acceptance should be recorded in the report.
